Clikalia is the owner of all rights to the Website. The simple access, surfing and use of the Website attributes the condition of user of the same (hereinafter, the "User") and implies the acceptance of this clause of Legal Notice and Conditions of Use. The information available through this website is not subject to contract and may be modified without prior notice.

Clikalia will guarantee confidentiality and anonymity (if the user so chooses), with respect to the personal data of the whistleblower.

Privacy Policy and data processing

HELAS assumes the status of data processor in relation to personal data that may be provided in complaints or queries to companies that have contracted the service with Clikalia, provided that the user does not choose anonymity. 

In the processing of personal data, HELAS undertakes to guarantee and protect public freedoms and fundamental rights of individuals and, especially, their honor and their family and personal privacy, obliging in this regard to carry out the corresponding data processing in accordance with current regulations at all times and to keep the most absolute secrecy in relation to the information that may be provided through the channel.

The data controller of the data sent through the channel of complaints or queries will be the company that has contracted the service, in this case, Clikalia. You can get more information about data processing in the Privacy Policy.

Intellectual and Industrial Property

Clikalia reserves all rights over trademarks, trade names or other distinctive signs, patents, and intellectual property, with respect to the content and design of the Web except for those reserved to the licensor or assignee of the use of the channel. All the contents of the Web, including without limitation, texts, graphics, images, its design, and the intellectual property rights that may correspond to said contents, as well as trademarks, trade names or any other distinctive sign are the property of Clikalia, except those reserved to the licensor or assignee of the use of the channel.

Terms of use for the user

• As a user you agree to make correct and lawful use of the platform.
• You will use the platform for the purposes it has been designed, and in no case will you use it for purposes contrary to the law.
• The ethical channel is not an emergency service. In case of emergency, contact your local authorities.
• You must complete all the information defined as mandatory.
• This service is not designed to present information that may be considered secret or strictly confidential.
• Reflect and review the information you send to ensure that if you do not want it, it does not reveal your identity.
• You can choose to send the communication indicating your contact information or anonymously. In both cases the platform will provide you with a unique identification number and an access code. It is important that you write them down in a safe place, only with them you can check the status of communication. If you lose them, you will not be able to access it again. For security reasons Clikalia will not be able to provide access to lost codes.
• If the organization finds that there has been bad faith in making the report, it reserves the right to take legal action if the complainant has been identified.
• You can download a certificate in which you will have all the information you have sent to the company, as well as the result once the investigation is finished.
• The query system has traces to help users identify improper access to their query.
• The Complainant expressly understands and agrees that Clikalia shall not be liable for any damage, interest, or harm direct or indirect, foreseen, or unforeseen, including but not limited to moral damage, resulting from the use or impossibility of using this service.
• The Complainant is responsible for the veracity of the information communicated, assuming the consequences of having acted in bad faith or sent false information or documentation.
• You will be liable for any damage or harm of any kind that Clikalia may suffer, directly or indirectly, because of improper use of the product, a breach of this Legal Notice and Conditions of Use or a breach of current law on your part.

Law and jurisdiction

This Legal Notice and Conditions of Use is subject by Spanish law. In case of dispute or controversy related to the application or interpretation of the clauses contained in the Legal Notice, the Parties will submit to the Courts and Tribunals that are territorially competent according to current legislation.
